Information sharing and disclosure
We do not sell, trade, or rent your personal information to third parties. We may share information in limited situations to comply with legal obligations, such as in response to a subpoena or court order. The Florida Department of State may disclose information and will attempt to notify you if legally required. Your data may also be shared with trusted third-party service providers like payment processors or in the event of a business transfer. For RON services, this includes our RON service provider. We will only share your information with our RON service provider as necessary to facilitate the online notarization process and in compliance with Florida law.
Remote online notarization (RON)
For remote online notarizations performed using audio-video communication technology, we adhere to the specific requirements outlined in Florida Statutes Chapter 117 Part II.
-
Identity Verification: For RON, we confirm the identity of the principal and any online witnesses using a combination of identity proofing and credential analysis as required by Florida law. This may involve knowledge-based authentication (KBA), credential analysis of government-issued identification, and remote presentation of identification.
-
Recording and Retention: All RON sessions are recorded and maintained for at least 10 years by our RON service provider, in accordance with Florida law. This recording captures the entire notarial act, including the identity verification process and the signing of the document.
-
Electronic Journal: We maintain a secure electronic journal for all remote online notarizations performed, as required by Florida law.
-
Security: We utilize a secure RON platform that employs measures such as end-to-end encryption, digital certificates, and tamper-evident technology to protect the integrity and confidentiality of your information during online notarizations.
Protecting your information
We use security measures to protect your personal information, including keeping your Notary journal confidential, encrypting sensitive data like payment information with SSL technology, and storing data securely with restricted access. We also require our RON service provider to implement similar security measures to protect your information during online notarizations.
Your choices and rights
You have the right to access and correct your personal information and to opt-out of marketing communications by contacting us.
Data retention
Your personal information is kept only as long as needed for the purposes outlined in this policy or as required by law, which for RON recordings is at least 10 years.
Notary public limitations
As a Notary Public, we can only perform specific notarial acts. We cannot provide legal advice, draft documents, notarize incomplete documents, or notarize for individuals not physically present for traditional notarizations.
